Overview and Objectives

Module 3 focuses on developing the essential skills required to draft a final, reasoned, and enforceable arbitral award in compliance with the UNCITRAL Model Law and other relevant legal frameworks. This module is designed for professionals aiming to deepen their understanding of the arbitral decision-making process, from evaluating evidence to applying the law and articulating clear conclusions.

Learning Outcomes

Upon successful completion of Module 3, candidates will be able to:

  • Recognize and evaluate various forms of evidence, including witness testimonies and expert reports.

  • Identify and analyze issues arising from parties' submissions.

  • Structure and address all issues in dispute logically and in accordance with applicable laws.

  • Draft the discursive and operative parts of an arbitral award effectively.

  • Address matters related to costs, interest, and arbitrator's fees and expenses within the award.

  • Ensure compliance with legal and procedural requirements for enforceability of the award.

Duration of the Course

The course spans over three months with three full day tutorials, combining self-paced private study with interactive virtual tutorials.

Assessment Format and Process

The Module 3 assessment is conducted via LearnADR, CIArb's online learning platform. It evaluates a candidate's ability to draft a final, reasoned, and enforceable arbitral award as a sole arbitrator in an ad hoc international arbitration. Structure of the Assessment:

  • Stage 1: It is released 10 days before the assessment start date on LearnADR. It includes background information, procedural details, and pre-hearing documents and helps candidates prepare for the main assessment.

  • Stage 2: It is released at 12:00 PM (London time) on the assessment start date. It stimulates the hearing stage with extracts from the arbitrator's notebook, Oral evidence and submissions, Other relevant documents, Candidates must independently make findings of fact and draft a final award. Multiple approaches are acceptable, provided reasoning is clear and well-founded.

Assessment Window: The assessment must be completed within any 48 consecutive hours during a 5-day period. Once started, the 48-hour window runs continuously and cannot be paused.

Evaluation Criteria:

  • Technical Merit (40%): Focuses on structure, accuracy, formal compliance, and completeness of the award.

  • Juridical Merit (60%): Assesses legal reasoning, application of the law, and analysis of submissions and evidence.

Passing Criteria: Minimum of 70% overall, with at least 70% in both Technical and Juridical Merit sections.

Eligibility Criteria
  • Completion of Module 1: Law, Practice and Procedure of International Arbitration

  • Completion of Module 2: Law of Obligations; or exemption from CIArb Module 2 – Law of Obligations

Course Fees

Tuition Fee: Rs. 70,000/- (Inclusive of taxes) – The tuition fees includes registration, access to virtual classrooms, and study materials.

Assessment Fee: 408 GBP – The assessment fee is not included in the course fees and shall be registered and paid separately to the Headquarters separately.

Certification and Progression

Successful candidates may schedule a Peer Interview with CIArb’s Membership in order to apply for Fellowship (FCIArb) with the Chartered Institute of Arbitrators.
